Booking and Service Agreement

Effective
Period

This agreement shall be effective once both parties sign and shall end at conclusion of the contracted time booked. Booking slots are held for 48 hours if not initially booked online. If agreement is not signed within 48 hours of time(s) requested, Simply Golden Solutions will open the time(s) for other clients. 

Service Description

Simply Golden Solutions will provide any of the following concierge services for Client as described below: 

• Completing miscellaneous household tasks including, but not limited to, light housekeeping, cupboard and drawer cleaning, refrigerator cleaning, decluttering and organizing, meal prep, etc. as requested; and/or

• Technology support including, but not limited to, cell phone/tablet/speaker set up/guidance/lessons, online payment systems, password setup/documentation as requested, online travel booking assistance; and/or

• Household management systems such as vendor connections and/or management, check-ins during travel, document management, holiday decorating and/or removal/take-down; and/or

• Running errands with or without non-emergency transportation services for the Client or the Client’s pet, transporting donations to donation locations; and/or

• Travel arrangements for lodging, transportation, and/or itineraries recommended and/or made in conjunction with Client; and/or

• Other services requested in writing by Client and agreed upon by parties

Service Charges

• Non packaged concierge service charges are $75 per hour. Additional time is billed in 15 minute increments also at $75 per hour.​

• Packages are priced separately and agreed upon when booking online.

• Rates may increase for flexible time (more than one visit per day).​ Quote will reflect the rate. ​

• Booking will reflect the price agreed upon between Provider and Client. ​

Payment Policies

Payment under this Agreement shall be made as follows:

• The Client must secure booking with a credit card. 

• Simply Golden Solutions will charge half the booking fee at the time of booking, with the second half and any additional fees charged at the conclusion of the booking.

• Adding grocery service at the time of booking, or anytime thereafter, incurs an agreed upon service fee. This service fee does not include the cost of the groceries or supplies Simply Golden Solutions picks up.

• Groceries/Supplies secured by Simply Golden Solutions will be agreed upon in writing by the Client before the scheduled errand.

• Groceries/Supplies secured by Simply Golden Solutions will be reimbursed by Client at the conclusion of the booking by adding the fee to the second half of the booking fee.

• Simply Golden Solutions shall provide Client a receipt of the requested groceries/supplies and agrees not to charge any additional fees on top of the cost incurred on the receipt.

• Additional Client expenses may be agreed upon between the Client and Simply Golden Solutions to be paid for by Simply Golden Solutions. Such expenses are invoiced weekly to the Client for reimbursement with receipts. Client is responsible to pay expenses within 48 hours from invoice.

• A late charge computed at a rate of one- and one-half percent (1.5%) of the outstanding balance will be charged on a monthly basis if not paid within 48 hours from invoice.

Rescheduling and Cancellations

Booked services may be rescheduled at no charge at least 24 hours in advance of booking time slot . Rescheduling less than 24 hours from booking time slot may incur a $75 charge since Simply Golden Solutions will be unlikely to rebook the time with such little notice. Cancellations forfeit paid deposit (half of booking service fee). 

Amendments

This Agreement may be amended at any time by Simply Golden Solutions or the Client in the event that such amendment is necessary, provided both Parties agree. All amendments must be in writing and agreed to by both parties.

Responsibilities

​The Client agrees to be responsible for the following:

• Provide the necessary requests to Simply Golden Solutions timely, in order for services outlined in this Agreement to be provided.​ This includes surveys and/or conversations regarding the service requested.

• Providing updated credit card information within 24 hours if credit card charge cannot be executed at conclusion of booking.

Simply Golden Solutions will be responsible for the following:

• Provide services as requested for all Client regardless of race, color, national origin, gender, age, religion, disability, sexual orientation, or gender identity;

• Comply with Federal and State Drug and Alcohol Free Workplace Standards;

• Provide motor vehicles that meet all Iowa Department of Transportation safety inspection requirements; 

• Ensure insurance policies are in place for the business, professional liability, and automobile(s). If such policy is required by law, minimum requirements are met.

Confidentiality

Simply Golden Solutions will keep any and all requested services confidential. Client may choose to provide a signed release for Simply Golden Solutions to share information with others. 

Simply Golden Solutions will keep any and all passwords and/or privacy data shared during booked sessions confidential. Electronic files used during sessions for the purposes of learning or teaching will be destroyed at the conclusion of the booking. 

In such cases confidentiality cannot be maintained as required by court or law, Simply Golden Solutions will abide by court and/or law requirements. 

Subcontracting

Simply Golden Solutions may subcontract any of the work contemplated under this Agreement without prior written approval from the Client. Simply Golden Solutions shall be responsible for the performance of all of its subcontractors. 

Assignment

The Client cannot assign its rights or obligations under this Agreement in whole or in part without the prior written consent of the Provider.

Liabilities

Each party hereto agrees to be responsible for its own liabilities arising out of this Agreement, including fiscal responsibilities for deviations from the terms of this Agreement. Simply Golden Solutions agrees to indemnify and hold harmless the Client from any liabilities, obligations, claims, damages, in the event of Simply Golden Solutions’ negligence. The Client agrees to indemnify and hold harmless Simply Golden Solutions from any liabilities, obligations, claims, damages, in the event of Client’s negligence. 

Point of Contact

The day-to-day dealings between Provider and the Client shall be as set forth below. Unless otherwise herein specified, all written notices, amendments and official correspondence concerning this Agreement shall be made between Client and the Provider at the following addresses:

Conditional waiver

Any liability on the part of the Provider to adequately or properly perform this contract based on any of the following events or occurrences is hereby waived by the Client:

• Adverse weather conditions that would create hazardous driving conditions;

• Unforeseen vehicle shortage;

• Shortages of fuels or lubricants beyond the control of the provider; and

• War, riot, revolution, terrorism, act of God or other unforeseen circumstances whether of the class of causes herein before enumerated or not.

Applicable
law

This Agreement shall be deemed to have been executed and performed in the State of Iowa, and all questions of interpretation shall be constructed by the laws of such state. Any venue shall be Polk County, Iowa.
